Connors LLP successfully obtains full payment from automobile insurance company.
On December 10, 2015, an Erie County jury returned a unanimous verdict in favor of a young man who was seriously injured in a hit and run motor vehicle collision in 2012.
Following a four day trial, before Erie County Supreme Court Justice Mark A. Montour, the jury made an award to a 36-year-old man who suffered injuries to his cervical spine in the collision. Because the other vehicle involved in the collision was reported stolen and the driver fled from the scene, the verdict was obtained against the young man’s own insurance company under the portion of his policy known as uninsured motorist coverage.
The insurance company argued that the young man’s injuries were not serious and that he was not due any compensation. The jury disagreed and awarded an amount in excess of the available policy limit.
The young man was represented by Joseph D. Morath, Jr., a partner with the firm. Mr. Morath is a trial attorney whose practice focuses on personal injury, wrongful death, and nursing home litigation.
